1. Acceptance of Terms

By accessing and using the services of Novaeon Force, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Service Description

Novaeon Force provides professional landscape design, installation, and maintenance services for residential and commercial properties in Kingston upon Thames and surrounding areas. Our services include but are not limited to:

• Garden design and planning
• Landscape installation
• Garden maintenance and care
• Consultation services
• Project management

3. Project Scope and Agreements

3.1 Proposals and Quotes

All project proposals and quotes are valid for 30 days from the date of issue unless otherwise specified. Prices are subject to change based on material costs and project modifications.

3.2 Project Changes

Any changes to the agreed project scope must be documented in writing and may result in additional charges. We reserve the right to adjust timelines based on project modifications.

3.3 Site Access

The client must provide reasonable access to the property during agreed working hours. Any delays caused by lack of access may result in additional charges.

4. Payment Terms

4.1 Payment Schedule

Payment terms will be specified in individual project contracts. Generally:

• Consultation fees are due upon completion of service
• Design fees are typically 50% upon agreement, 50% upon completion
• Installation projects require staged payments as outlined in contracts

4.2 Late Payments

Late payments may incur interest charges of 1.5% per month on outstanding balances.

5. Warranties and Guarantees

5.1 Plant Warranty

We provide a 12-month warranty on all plants installed, subject to proper care and maintenance by the client. This warranty covers replacement due to disease or poor establishment, but not damage from weather extremes, pests, or improper care.

5.2 Workmanship Warranty

We guarantee our workmanship for 24 months from project completion, covering defects in installation and construction.

6. Limitations of Liability

Our liability is limited to the value of services provided. We are not responsible for:

• Damage to existing structures or utilities not identified during initial assessment
• Weather-related delays or damage
• Consequential or indirect damages
• Acts of third parties

7. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, weather conditions, strikes, or government regulations.

8. Intellectual Property

All design concepts, plans, and materials created by Novaeon Force remain our intellectual property until full payment is received. Unauthorized reproduction or use of our designs is prohibited.

9. Privacy and Data Protection

We are committed to protecting your privacy. Please refer to our Privacy Policy for details on how we collect, use, and protect your personal information.

10. Cancellation Policy

10.1 Client Cancellation

Clients may cancel projects with written notice. Cancellation charges may apply based on work completed and materials ordered.

10.2 Company Cancellation

We reserve the right to cancel projects due to unsafe working conditions, non-payment, or breach of contract terms.

11. Dispute Resolution

Any disputes arising from our services will be resolved through mediation or arbitration in accordance with UK law. The jurisdiction for any legal proceedings shall be the courts of England and Wales.

12. Health and Safety

We maintain comprehensive insurance and adhere to all relevant health and safety regulations. Clients must ensure their property is safe for our team to work on and inform us of any potential hazards.

13. Environmental Responsibility

We are committed to sustainable practices and will dispose of all materials responsibly. We encourage the use of native plants and environmentally friendly solutions where possible.

14. Modifications to Terms

We reserve the right to modify these terms at any time. Updates will be posted on our website and take effect immediately upon posting.
